Brokerage Agreement

  1. I undertake to comprehensively insure the vessel including a minimum of £1,000,000 Third Party Indemnity and to maintain such cover whilst the vessel remains the subject of this agreement.
     

  2. I understand that all costs incurred by VIKING MARINE (GOOLE) Ltd. necessary to prepare the craft for acceptance shall be on my account and shall be deducted from the proceeds of the sale.
     

  3. I understand that VIKING MARINE (GOOLE) Ltd. will undertake to offer the vessel for sale for a minimum period of 90 days and thereafter the agreement shall continue until terminated by either party by written notice.
     

  4. I accept liability for all accounts arising in respect of hard standing/mooring whilst the vessel is stored at VIKING MARINE (GOOLE) Ltd's premises, and that in the event of a successful sale, I shall be credited with up to days free storage.
     

  5. Should the vessel be withdrawn from sale and subsequently sold to a person or his agent who has seen the vessel offered
    for sale on VIKING MARINE (GOOLE) Ltd's premises, or has been introduced to the vessel by VIKING MARINE (GOOLE) Ltd, I understand that I shall still be liable for the full, agreed, brokerage fee.
     

  6. Should the vessel be sold privately whilst subject to this agreement I understand that I shall be liable to pay 1% of the
    asking price to cover expenses and advertising.
     

  7. No customer will be allowed unescorted access to the vessel and a representative of VIKING MARINE (GOOLE) Ltd. may operate the said vessel for the purposes of trials and handover prior to acceptance.
     

  8. I or my agent agree to visit the vessel at regular intervals and to maintain the vessel in a clean and presentable condition and that all loose gear and equipment shall be stored away securely.
     

  9. I undertake to inform VIKING MARINE (GOOLE) Ltd. of any structural, mechanical or material defect in the vessel. Failure to do so or to vary the condition and specification details attached, may be deemed to be a breach of contract, either where the vessel is offered under brokerage or taken in part exchange by VIKING MARINE (GOOLE) Ltd.
     

  10. I understand that VIKING MARINE (GOOLE) Ltd. and their employees accept no responsibility for loss, damage or delay arising from any cause whatsoever unless such loss, damage or delay was caused by, or resulted from their negligence or deliberate act or that of those whom they are responsible. Subject to that exception, all vessels and gear are repaired, worked on, moved, stored and otherwise managed and kept at the sole risk of the owner.
     

  11. I understand that all persons using any part of VIKING MARINE (GOOLE) Ltd's premises and/or facilities for whatever purpose and whether by invitation or otherwise, do so at their own risk, unless any injury or damage to person or property sustained within the premises and/or facilities was caused by, or resulted from their negligence or deliberate act or that of those for whom they are responsible.
     

  12. I am the owner of the vessel which is the subject of this agreement and am authorised to sell it. Claims by others on this vessel in any form (Credit finance agreements, other debts, claims of ownership by other persons etc.) are as follows :-

I further agree that VIKING MARINE (GOOLE) Ltd. shall settle the outstanding debts shown above from the proceeds of the sale.

  1. I understand settlement of sale proceeds will not be made until the brokerage documentation is completed and transfer of title has taken place. A minimum period of 21 days from date of acceptance (as defined in Clause 6 of the Agreement for the Sale & Purchase of Second-hand Yacht) will therefore elapse before payment is made.
     

  2. I understand VIKING MARINE (GOOLE) Ltd. will act as sole agents in offering and selling the subject of this agreement at the price shown or otherwise agreed, from which shall be deducted the following Brokerage fee :-
